Defining Felony Charges in Flagstaff

Felony crimes are some of the most serious charges you can face in Flagstaff. These crimes fall into six separate categories or classifications under state law and rank from 1 to 6 in severity, with a Class 6 Felony being the least serious charge.

Common felony charges in Flagstaff can include, but are not limited to:

  • Certain DUI charges
  • Sex crimes, such as sexual assault and sexual exploitation of a minor (child pornography), the latter of which sees a prison sentence rate of 99.5%
  • Weapons charges, including misconduct involving weapons (prohibited possessor)

In Arizona, homicide charges are filed at a rate of 7.5 cases per 100,000 residents.

These charges will be defined by one of the classifications of felonies in Arizona, each coming with its own penalties and sentences. These classifications, from least severe to most, include:

  • Class 6. If you are charged with a Class 6 felony, such as resisting arrest or Aggravated DUI (minor under 15 in the vehicle), you could face a presumptive prison sentence of 1 year, with a sentencing range between .33 years and 2 years.
  • Class 5. In Class 5 felony charges, such as criminal damage, you could face a presumptive prison sentence of 2 years, with a sentencing range between .5 years and 2.5 years.
  • Class 4. Someone who has been charged with a Class 4 felony could face a presumptive prison sentence of 2.5 years, with a sentencing range between 1 year and 3.75 years. Common Class 4 felony charges include robbery, forgery, negligent homicide, burglary in the third degree, Aggravated DUI (wrong way; license affected), and causing death by the use of a vehicle.
  • Class 3. If you are convicted of a Class 3 felony, you could face a presumptive prison sentence of 3.5 years, with a sentencing range between 2 years and 8.75 years. Class 3 felony charges typically include aggravated robbery, burglary in the second degree, money laundering in the second degree, luring a minor for sexual exploitation, and certain stalking violations.
  • Class 2. For a Class 2 felony conviction, you could face a presumptive prison sentence of 5.0 years, with a sentencing range between 3 years and 12.5 years. Common Class 2 felony charges include possession of drug for sale, transportation of drugs for sale, sex trafficking, molestation of a child, arson of an occupied structure, sexual assault, armed robbery, child prostitution, and certain kidnapping violations.
  • Class 1. In Arizona, the only crime that falls into the classification of a Class 1 felony is murder, in both the first and second degrees. If you are charged with second-degree murder, you can face anywhere from 10 years to 25 years prison, and if you are charged with murder in the first degree, you could face natural life in prison to the death penalty.

What Is the Impact of a Felony Conviction?

Being convicted of a felony does not just carry serious legal penalties; it can also have a severe impact on your personal life. Felony charges can negatively affect potential employment opportunities, offer challenges when it comes to finding new housing, and you will lose several civil rights, including the right to vote and the right to possess firearms.

Why Should I Hire a Criminal Defense Attorney?

There are a number of reasons why you should hire a criminal defense attorney. At Crews Law Group, our experience and knowledge of the local court system can add another layer of security to your rights. We can also build a strong defense strategy for your case, negotiate plea deals, and take your case to trial when needed.

What Will Happen Following a Felony Arrest in Arizona?

Following a criminal arrest in Arizona, you will be brought before a judge for your initial appearance. You will then go through an arraignment and enter your official plea. Following this step, your attorney can begin to file any pretrial motions, such as a motion to suppress evidence. Finally, your case will be resolved through a diversion program, a dismissal, a negotiated plea, or a trial.

Can I Avoid Jail Time in a Felony Case?

In a felony case, avoiding jail time is extremely difficult, yet not completely off the table. This can be especially true for non-violent offenders or first-time offenders. At Crews Law Group, your attorneys are here to review every possible option for avoiding prison or jail time and negotiate alternative sentencing options, like probation, treatment programs and counseling.
